Terms of service

Last updated: 24 October 2026

These Terms of Service ("Terms") apply to your use of this website and to any purchase from Dylvera Chef, a trading name of DYLVERA LLC, a limited liability company registered in New Mexico, United States (EIN 98-1983897). By placing an order you agree to these Terms, together with our Refund Policy, Delivery Policy and Privacy Policy.

1. Who we are

DYLVERA LLC (trading as Dylvera Chef) · EIN 98-1983897
1209 Mountain Rd Pl NE, Ste R, Albuquerque, NM 87110, United States
Email: contact@dylverachef.com · Phone: +1 575 251 2183

2. Our products

We sell digital cookbooks, meal plans and training routines supplied as downloadable PDF files. No physical product is shipped. Each product page states what is included (for example the number of recipes and pages, the skill level and the file format) and the technical requirements: a device with a PDF reader. Images labelled "sample page layout" show the design style of the pages.

3. Prices, taxes and payment

  • Prices are shown in the currency displayed in the store. Where the law of your country requires it (for example in the EU, UK and Australia), displayed prices include VAT/GST; otherwise any applicable taxes are shown before you pay. The total you pay is always shown at checkout before you confirm your order.
  • Payment is taken in full at checkout by card or supported digital wallet. Your statement will show DYLVERA LLC.
  • Guides and bundles are one-off payments. You are never charged again for them.
  • If your bank converts currency, it may charge its own fees, which we do not control.
  • Where a bundle shows a "separately" price, it is the total current price of the included products if bought individually in our store.
  • If a price is obviously wrong because of an error, we may cancel the order and refund you in full.

3A. Kitchen Club membership, additional purchases and saved payment details

This section sets out the terms of the optional Dylvera Kitchen Club membership, additional purchases and the use of saved payment details.

Optional monthly membership

You can add an ongoing monthly membership, the Dylvera Kitchen Club, when you check out: a new 4-week meal plan with shopping lists, fresh seasonal recipes and cooking Q&A by email, every month. It renews every month at the price shown at checkout until you cancel, and you can cancel any time by emailing us.

The membership is always optional. It is not required to buy any guide, and accepting our Terms of Service does not by itself enrol you. You only become a member if you choose to add the membership and agree to the recurring payment at checkout.

Price and billing

  • Price: A$49.99 per month in Australia, or the equivalent shown in your local currency at checkout. Taxes are included or shown at checkout as required in your country.
  • First payment: charged when you join. Your first plan is delivered straight away.
  • Renewals: charged automatically every month on the same date as your first payment (or the closest date in shorter months), until you cancel.
  • How we charge: your payment details are stored securely by our payment provider so renewals can be taken automatically ("off-session" payments). They are used only for the membership payments you agreed to and additional purchases you individually confirm.
  • Price changes: we will email you at least 30 days before any price change takes effect. You can cancel before then; if you don't, the new price applies from your next renewal after the notice period.
  • Failed payments: if a renewal fails, we may retry it during the following 7 days and will email you. If it still fails, the membership is paused or cancelled; we never charge late fees.

Reminders and confirmations

  • When you join, we email a confirmation with the price, billing frequency, next billing date and how to cancel.
  • You receive a receipt by email after every payment.
  • When you cancel, we confirm the cancellation by email, with the date and time we received it and the date your membership ends.

How to cancel

You can cancel at any time, with no minimum term and no cancellation fee, by emailing contact@dylverachef.com (or simply replying to any membership email) with your name and order number. We confirm every cancellation by email.

To avoid the next charge, cancel at least 24 hours before your next billing date. Cancellation takes effect at the end of your current billing period. You keep all plans and recipes already delivered.

Refunds

  • Months already delivered are not refunded for change of mind, because each month's content is delivered instantly at your express request.
  • Forgot to cancel? If you contact us within 7 days of a renewal and haven't downloaded that month's plan, we'll refund that renewal in full.
  • Any payment taken in error, or after you cancelled, is refunded in full.
  • Your statutory consumer rights always apply — see our Refund Policy.

Additional purchases

On our website or after checkout we may offer other e-books, mini-guides, add-ons and related digital resources. These are optional purchases charged separately from your initial order or membership. Each price is displayed before you agree to buy, and you will only be charged when you confirm the additional purchase. Using our website, buying an initial product or being a member does not by itself authorise further payments.

Changes to the membership

We may improve the content of the membership. If we make a change that materially reduces what you receive, we will tell you in advance and you may cancel and receive a pro-rata refund for any unused period.

Your rights in the EU, EEA and UK

When you join, you expressly request that we start supplying digital content immediately and acknowledge that you lose your right of withdrawal once the first plan has been delivered. If you did not give that consent, you can withdraw within 14 days by emailing us or by using the model withdrawal form in our Refund Policy. Your right to cancel the membership at any time is not affected.

Saved payment details and off-session payments

When you join the membership, or confirm an additional purchase, you authorise us to store your payment details securely with our payment provider (for example Stripe or Shopify Payments) and to charge them without you re-entering them — so-called "off-session" or merchant-initiated payments. We use stored payment details only for: (a) the recurring membership payments you agreed to, at the price and frequency shown when you joined; and (b) additional purchases you individually confirm. We never use them for any other charge. You can withdraw this authorisation at any time by cancelling your membership and emailing us; this does not affect payments already made. We do not store full card numbers ourselves.

4. How your contract is formed

Placing an order is an offer to buy. The contract is formed when we confirm your order by email. Your order confirmation includes a summary of the products, the price and your checkout acknowledgement, and serves as confirmation on a durable medium. Our Terms are available on this website at all times and you can save or print them.

5. Delivery and immediate access

Files are made available immediately after payment on the confirmation page and by email (see our Delivery Policy). In the cart, before checkout, we ask you to expressly request immediate access to the digital content and to acknowledge that you lose any statutory right of withdrawal once delivery or download has begun. Where you have not given that confirmation, any statutory withdrawal right you have is not affected.

6. Refunds and statutory rights

If a product is faulty, inaccessible or not as described, we will fix, replace or refund it as set out in our Refund Policy. We do not offer refunds for change of mind once delivery has begun. Nothing in these Terms limits mandatory consumer rights you have in your country, including under EU consumer law, the UK Consumer Rights Act 2015, the Australian Consumer Law and the New Zealand Consumer Guarantees Act.

7. Licence and intellectual property

When you buy a product, we grant you a personal, non-exclusive, non-transferable, perpetual licence to download, view and print it for your own household's non-commercial use. You may not share, resell, upload, distribute, translate or publish the files (or substantial parts of them), or use them to train artificial intelligence systems or create competing products. All content, designs and images remain the property of DYLVERA LLC or its licensors.

8. Health and safety

Our products provide general information and recipe ideas only. They are not medical, nutritional, dietary or fitness advice and are not a substitute for advice from a doctor, registered dietitian or other qualified professional. Nutrition values are estimates. Always check ingredients for allergens, follow safe food-handling practices and consult a professional before changing your diet or starting an exercise program — especially if you are pregnant or breastfeeding, have a medical condition or a history of disordered eating, or take medication. Stop any exercise that causes pain, dizziness or discomfort. We do not promise any particular health, weight or fitness result; individual results vary.

9. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer guarantees. Subject to that, and to the extent permitted by law, our total liability for any claim relating to a product is limited to the price you paid for it, and we are not liable for indirect or consequential losses that were not reasonably foreseeable.

10. Your account and conduct

Please provide a correct email address so that we can deliver your products, and keep your account details secure. You must not misuse the website, attempt to gain unauthorised access, or interfere with its operation.

11. Reviews

Any reviews published on our website come from genuine customers. We do not write, buy or selectively edit reviews, and we never offer incentives in exchange for positive reviews.

12. Complaints and disputes

If you have a complaint, please email us first — we aim to respond within 2 business days. We are not obliged and do not currently agree to take part in alternative dispute resolution proceedings before a consumer arbitration board, but this does not affect your right to go to court or to use any dispute-resolution service available to you by law.

13. Governing law

These Terms are governed by the laws of the State of New Mexico, United States. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of your country of residence.

14. Changes

We may update these Terms from time to time. The version published when you place your order applies to that order.
